Terms of Service & User Agreement

These Terms govern your use of TCGPursuit. By creating an account or using the service, you agree to them. If you do not agree, do not use the service.
1. The service
TCGPursuit is software that helps trading-card sellers manage inventory, research market prices, and create, publish, and manage listings on eBay and related tasks. Features and availability may change over time.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for your account, for keeping your credentials secure, and for all activity under your account.
3. Acceptable use
You agree not to:
- Use the service for any unlawful purpose or in violation of eBay's or any third party's policies or terms.
- Upload content that is illegal, infringing, sexually explicit, exploitative, or that you do not have the right to use.
- Attempt to disrupt, reverse engineer, scrape, or gain unauthorized access to the service or its infrastructure.
- Resell, sublicense, or share access to the service without our permission.
- Abuse rate limits, API quotas, trials, or promotional offers.
4. eBay and third-party services
TCGPursuit connects to eBay and other third-party services on your behalf. You are solely responsible for your own eBay account, your listings, and your compliance with eBay's rules, fees, and policies. We are not affiliated with or endorsed by eBay, and we are not responsible for actions eBay takes regarding your account or listings.
5. Pricing data and estimates
Price research, repricing, flip, and grading figures are estimates derived from available marketplace data (primarily active eBay listings, and where available, recent sold data and third-party references). They are not guarantees of value or of a sale price. You are responsible for the prices you set and the business decisions you make.
6. Your content
You retain ownership of the data and images you provide. You grant us a limited license to host, process, and transmit that content as needed to operate the service (including uploading images to eBay at your direction). You represent that you have the rights to the content you upload.
7. Subscriptions, billing, and trials
Paid plans are billed in advance through Stripe on a recurring basis until cancelled. Free trials, if offered, convert to a paid subscription unless cancelled before the trial ends. You can cancel at any time; cancellation stops future charges and takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
8. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any estimate or recommendation will be accurate.
9. Limitation of liability
To the maximum extent permitted by law, TCGPursuit and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
10. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service or other users.
11. Changes to these Terms
We may update these Terms. Material changes will be reflected by the "Last updated" date above; continued use after changes means you accept them.
12. Governing law
These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-law rules.
